Types of Rape


Statutory Rape 

Sexual intercourse with an individual who is below the statutory age of consent. 
Acquaintance Rape
The victim knows their attacker, although they are not a not a close friend or family member.  This is one of the more numerous types of rape. 
Stranger Rape 
A person who the victim does not know rapes them.
Date Rape
The victim is dating the person who rapes them.  Some times the rapist will use drugs, alcohol or a mixture of both to subdue the victim in order to have sexual intercourse.
Gang Rape 
The victim is raped by more than one person.
Marital Rape
The victim is raped by their spouse.  This is probably the hardest out of all definitions to prove in a court case.

Legal Definitions


Attempted Rape/Sexual Assault

An attack on the individual with the intent to rape. Unlike rape there is no penetration.  This is categorized as a "specific intent" crime and it must be proved that the accused intended to rape the victim.
Consent
An accused's reasonable belief that the victim was consenting to an act of sexual sexual intercourse. 
Reasonable Belief in Consent
Even when the accused uses force the intercourse may not constitute rape.  This could be where the person submits to sex through fear but the other person believed they gave consent therefore there is no force able rape. However; this is not likely when any amount of force is applied.
